Can online activity hurt your chances at custody?

Social media has become a regular part of life. Many people turn to social media to talk about their lives and share information with others. It is a great way to stay in contact with friends and family. It also can become a liability in a legal sense. Law enforcement often uses social media for hunting down criminals or find evidence of crimes. A court may also look to social media as a way to determine your fitness as a parent.

The National Law Review reports that what you post on social media becomes available to the public. If your posts offer proof of nefarious activities, it could hurt you when you go to court for a child custody hearing. Photos are the most damaging evidence, especially if they show you using drugs or drinking alcohol. Things you say could be used as well. This is true if you bad mouth the child’s other parent often on social media.

You should always be careful with what you put out there to the public. Anyone can get that information and use it against you. When it comes to a child custody case, your child’s other parent will be actively looking for such evidence. The court will not look kindly if he or she can show a pattern of behaviors that could be harmful to the child. After all, the court makes custody decisions based on what is best for the child.
