Are you worried about your ex gaining custody?

On Behalf of | Aug 30, 2022 | Child Custody

Divorce can be testing for all parties involved. When children are at the center of the process, things can get much more complex. Your priority as a parent will be to ensure that the kids are secure. The court will also aim to reach their conclusions based on the best interests of the child.

Are you concerned about your child’s welfare in your ex’s custody? For the court to restrict the custody rights of your co-parent, they will most likely need evidence of exceptional circumstances. Outlined below are some factors that may influence the court’s decisions on this matter.

Allegations of violence

Unfortunately, your relationship took a turn for the worst and you were subjected to domestic violence. If the allegations you make are substantiated, then this could affect the court’s decision on custody rights.

While your ex may not be completely forbidden from seeing the child, they may be ordered to see them only under supervised visitation.

Substance abuse

If your ex has become addicted to substances, then this will likely factor into any custody decisions. The courts may demand to see evidence that your co-parent has sought help in dealing with these issues before granting further custody rights

Again, decisions will be based on the best interests of the child and it’s likely that supervised visitations will be required under these circumstances.

If you have any concerns about your child’s welfare or your custody agreement, then it’s best to seek legal guidance. This will help you to gain a suitable custody arrangement during the divorce or even make modifications afterward.
